General contract terms and conditions

The General Terms and Conditions of Service (“GTS”) contain Spitzer Gyöngyi EV. (Headquarters: 2011 Budakalász, Csalogány Street 9., Registration authority: District Central Notary Office, Tax number: 63716638-1-33) , as a service provider (“Service Provider”) operated by www.tanglystudio.com general terms and conditions for the use of the website and webshop. Please use our services only if you agree with all points and consider them binding on you. This document will not be filed, it will be concluded exclusively in electronic form (it does not qualify as a written contract), it does not refer to a code of conduct.

Basic provisions

 

1.1. Hungarian law shall govern any issues not regulated in these Regulations and the interpretation of these Regulations, with particular regard to the relevant provisions of Act V of 2013 on the Civil Code on Fulfillment services for webshops (“Civil Code”) and Act CVIII of 2001 on certain issues of electronic commerce services and services related to the information society. The mandatory provisions of the relevant laws shall apply to the parties without any separate stipulation.

 

1.2. Scope of the contract

This contract comes into force upon approval of the order and is concluded upon fulfillment of the order. In the case of a continuous order, the contract remains in force until all claims of the parties against each other are met. The system rented by the Service Provider automatically assigns an order identification number to each valid order, which is communicated in the order confirmation e-mail sent to the address provided by the Customer. Only orders with an order identification number are valid! By browsing the pages of www.tanglystudio.com and placing their order, the Customer accepts the Service Provider's general terms and conditions and data processing principles. In the case of content that does not comply with the provisions of the Civil Code, Government Decree 17/1999 (II.5.) on distance contracts, and Act CVIII of 2001 on certain issues of electronic commerce services and services related to the information society, or with the current legislation, the contract shall not be considered null and void. In this case, the currently effective Hungarian laws, regulations and regulations apply instead of the disputed content.

The service provider is entitled to change the provisions of these GTC within the framework of the applicable laws. Please read the provisions of the GTC before every purchase, as any possible modification of the GTC is valid from the time of its publication on the website. Any possible changes will not retroactively affect contracts (confirmed orders) that have already been concluded.

 

1.3. The Website is protected by copyright. The Service Provider is the copyright holder or authorized user of all content displayed on the Website and in the course of providing services available through the Website: any copyrighted work or other intellectual creation (including, among others, all graphics and other materials, the layout and editing of the Website's interface, the software and other solutions used, ideas, implementation). The storage, transmission, publication, commercialization of the content of the Website and its individual parts for use other than private purposes is permitted only with the prior written consent of the Service Provider.

 

Data processing rules

When using our webshop, we treat the personal data provided to the Seller confidentially and do not disclose it to any other party, except in the case where it is a subcontractor of the Service Provider. (Eg: Courier service, for the delivery of the order). The legal basis for data management is voluntary consent under the Data Protection Act, for the purpose of using the webshop services, in fulfillment of a contract concluded between distant parties (Government Decree 17/1999 (II.5.). While browsing the webshop, technical information is recorded for statistical purposes. (IP address, duration of visit, etc.). The Service Provider only transfers this data to the authorities in legally justified and substantiated cases (authority order, court judgment). Cookies must be enabled to use the service. If you do not want to allow the use of cookies, you can disable them in your browser settings. If cookies are disabled, certain elements of the service can only be used partially or not at all. A cookie is a file that the server sends to the user's browser and that is stored on the user's computer. No personal data is stored in the cookie. The data recorded during the order is used by the Service Provider to fulfill the order. The invoice data generated by the individual IT systems from the order placed on the web store pages is recorded with the data provided during the order placement and is stored for the period specified in the effective accounting law. The data processed are registration, order data, and non-essential data. The data provided during the newsletter subscription provided during browsing our web store is treated confidentially, the option to unsubscribe is provided at the bottom of every newsletter sent, and can also be requested at the contact details provided. You can request the deletion or modification of your data at any time in writing at tanglystudio@gmail.com.

1.6. Our prices are the list prices valid at the time of the order, which can be found next to the products in the webshop. The prices are gross prices, including VAT, but these prices do not include shipping costs. The shipping costs can also be found during the checkout process before finalizing the order, as well as under the heading “Shipping”. If an error or omission occurs in the products or prices in the webshop, we reserve the right to correct it. In such a case, we will inform you of the new data immediately after the error is recognized or modified. After that, you can confirm the order once again, or it is possible for either party to withdraw from the contract.

 

1.7. In the webshop, the Service Provider displays the product name and description in detail, and displays photos of the products. The images displayed on the product data sheet may differ from the actual product, and in some cases they are used as illustrations.

 

1.8. If a promotional price is introduced, the Service Provider will fully inform Users about the duration of the promotion.

 

Order process


Orders can be placed electronically, by phone and by email.

 

  1. Place the selected item in the cart (“add to basket”).

  2. If you would like to add more products to your cart, continue browsing. If you do not wish to purchase more products, check the quantity of the product you wish to purchase, move the cursor to the amount displayed in the upper right corner and click the “view basket” button to view it. The “quantity” column shows the number of products placed in the cart, you can change the quantity using the arrows next to it. You can delete the contents of the cart by clicking the “X” button. After entering the quantity, the contents of the cart must be updated using the “update basket” button.
  3. By clicking the "proceed to check out" button: enter shipping and billing information. Registration is not required to submit the order.
    4. Finalizing your order: after entering your details, you can send your order by clicking the "place order" button, but before that you can check the details once again and send a comment.
  4. After submitting your order, you will receive an automatically generated confirmation via email. The confirmation only confirms that your order has been received by the Service Provider.
  5. If necessary, we will confirm your order by phone and coordinate the details!

It is important to ensure that the data is accurate, as the product will be invoiced and shipped based on the data provided. If an order or orders are modified or merged for any reason, the modified order will be subject to the conditions valid at the time of the modification. You only need to complete the registration once, you will not need to complete this step for subsequent purchases. 

 

The webshop does not enter into contracts with minors. By accepting the terms and conditions, the customer declares that he is of legal age.

 

If the e-mail confirming the purchase does not reach the Customer within 48 hours, the Customer is not obliged to purchase the product or use the service. The confirmation only confirms the receipt of the order by the Service Provider. In the event of a low price or shortage of stock confirmed by mistake or due to a program error, the Service Provider is not obliged to deliver the product under the conditions set out in the automatic confirmation. Please check whether you have entered your e-mail address correctly, the storage capacity of your mailbox, and possibly the mail filter/spam folder of your mailbox. During registration, the mandatory fields must be filled in completely in order to complete the order. The Service Provider is not liable for any damages resulting from failure to do so or for technical problems arising during the process. The Customer is responsible for any shipping and other additional costs incurred due to incorrect or insufficiently detailed shipping information or other data. Please report any incorrect data or information you notice after confirming the order as soon as possible. For faster correction, the Customer may also contact us by phone, but we definitely require confirmation by e-mail to tanglystudio@gmail.com. If the correction of the incorrect data is not received by e-mail, the Operator is not obliged to fulfill the order due to incorrect data.

 

1.11. Payment options, delivery methods

The Customer selects the payment and delivery method.

Delivery is possible in several ways: you can either request the product by post, or at a FoxPost parcel machine, or request home delivery, or you can choose personal collection.
The postage fee depends on the size and weight of the product and ranges from 200 HUF to 10,000 HUF, the FoxPost automatic fee is 1,141 HUF, the FoxPost home delivery fee is between 2,400 HUF and 4,686 HUF, depending on the size of the package, and personal pickup is free.
Personal collection of the product is possible after purchase by personal arrangement.

 

1.12. Order processing and fulfillment

When are orders processed?


Orders are processed on business days from 9:00 AM to 5:00 PM. Orders can also be placed outside of the designated processing time. If your order arrives after business hours, it will be processed the next business day.

 

1.13. General delivery deadline, within 12 working days from the confirmation. If the Service Provider and the User have not agreed on the delivery date, the Service Provider is obliged to deliver the order in accordance with the contract on or within the time specified in the User's notice, or in the absence of a notice, no later than thirty days from the date of receipt of the order by the Service Provider.

 

1.14. If the Service Provider fails to fulfill its contractual obligations because the product specified in the contract is not available, it is obliged to inform the User immediately and to refund the amount paid by the User immediately, but no later than within thirty days. Fulfillment of this obligation does not exempt the Service Provider from other consequences of its breach of contract.

 

Right of withdrawal

1.15. Pursuant to Government Decree 45/2014. (II.26.) on the detailed rules of contracts between consumers and businesses, the User may withdraw from the contract without giving any reason and return the ordered product within 14 days of receiving the ordered product.

 

1.16. The procedure for exercising the right of withdrawal… (when the buyer can exercise it, when not, the web store will refund the price immediately, but no later than within 14 days, exceptions, etc.)
You can exercise your right of withdrawal within 14 working days of receiving the product by sending a written statement to our Company (by e-mail, by post), without giving any reasons. When notifying in writing by post, we will take into account the date of posting. In the event of withdrawal, we are obliged to transfer the full purchase price, including shipping costs, to the bank account number provided by the Customer only if the product is returned undamaged and used for its intended purpose. We will return the purchase price within 30 days of receiving the product. The Customer bears the costs incurred in returning the goods due to exercising the right of withdrawal. In the event of notification by post, it is essential to send your notification as a registered mail item, so that you can prove the date of posting. The Service Provider is not obliged to accept a product returned with cash on delivery. The Service Provider may demand compensation from the Customer for damages resulting from improper use. After the package arrives at our company, the unpacking of the package and the inspection of the returned product may be recorded with a video camera. This is necessary to avoid any possible misunderstandings later. If the Customer does not communicate or exercise his right of withdrawal in accordance with these laws and GTC, the Service Provider will not refund the purchase price. After consultation, the product can be re-delivered to the Customer at the Customer's own expense.   Guarantee, warranty

1.17. We offer a 6-month warranty on our products. In the event of a malfunction, you will be informed about the steps to be taken in person or by phone at any of the service centers listed in the warranty letter, or we will also provide information at one of our contact details. Warranty 

In what cases can you exercise your right to a warranty? 

In the event of defective performance by Spitzer Gyöngyi ev., you may assert a warranty claim against the company in accordance with the rules of the Civil Code. 

What rights do you have based on your warranty claim? 

You may – at your choice – make the following warranty claims: 

You may request repair or replacement, unless the fulfillment of the claim you have chosen from these is impossible or would entail disproportionate additional costs for the company compared to the fulfillment of your other claim. If you did not or could not request repair or replacement, you may request a proportionate reduction in the consideration or you may repair the defect yourself at the company's expense or have it repaired by someone else or - as a last resort - you may withdraw from the contract. 

You may switch from your chosen warranty right to another, but you will bear the cost of the switch, unless it was justified or the business gave a reason for it. 

Within what deadline can you assert your warranty claim? 

You are obliged to report the defect immediately after its discovery, but no later than within two months of its discovery. However, I would like to draw your attention to the fact that you cannot enforce your warranty rights beyond the two-year limitation period from the performance of the contract. In the case of used goods, this period is a maximum of one year. 

Against whom can you assert your warranty claim? 

You can assert your warranty claim against the company. 

What other conditions are there for enforcing your warranty rights? 

Within six months of delivery, there is no other condition for asserting your warranty claim than communicating the defect, if you prove that the product or service was provided by Autistic Art Kft. However, after six months from delivery, you are required to prove that the defect you identified already existed at the time of delivery. 

8.2. Product warranty 

In what cases can you exercise your product warranty rights? 

In the event of a defect in a movable item (product), you may – at your choice – assert your right specified in point 1 or a product warranty claim. 

What rights do you have based on your product warranty claim? 

As a product warranty claim, you can only request the repair or replacement of the defective product. 

In what cases is a product considered defective? 

A product is defective if it does not meet the quality requirements in force at the time of its release or if it does not have the properties specified in the description provided by the manufacturer. 

Within what deadline can you assert your product warranty claim? 

You can make a product warranty claim within two years from the date the product was placed on the market by the manufacturer. After this period, you will lose this right. 

Against whom and under what other conditions can you assert your product warranty claim? 

You can only exercise your product warranty claim against the manufacturer or distributor of the movable property. In the event of a product warranty claim, you must prove the defect in the product. 

In what cases is the manufacturer (distributor) exempt from its product warranty obligation? 

The manufacturer (distributor) is only exempt from its product warranty obligation if it can prove that: 

  • the product was not manufactured or placed on the market as part of its business activities, or
  • the defect was not detectable at the time of placing on the market according to the state of science and technology, or
  • the product defect results from the application of a law or mandatory official regulation.

The manufacturer (distributor) only needs to prove one reason to be exempted. 

Please note that you cannot assert a warranty claim and a product warranty claim simultaneously for the same defect. However, if your product warranty claim is successful, you may assert a warranty claim against the manufacturer for the replaced product or repaired part.

Miscellaneous provisions

 

The Service Provider and the User shall attempt to settle their disputes amicably. The User and the Service Provider shall agree to the following for any legal disputes falling within the scope of these Regulations that cannot be settled by agreement within 30 (thirty) calendar days:
